Welcome to DinkiRide. These Terms and Conditions govern your use of our website, platform, and services. DinkiRide is an online peer-to-peer marketplace that connects drivers who have empty seats in their vehicles with passengers traveling along the same route to share commuting expenses.

By registering an account or using the Platform in Queensland, Australia, you agree to comply with and be bound by these Terms. If you do not agree, please do not use the Platform.

1. The Role of DinkiRide

DinkiRide operates strictly as an intermediary digital platform. DinkiRide does not own, manage, or operate any vehicles, nor do we employ any Drivers. All rides arranged through the Platform are independent arrangements between the Driver and the Passenger.

2. User Accounts and Verification

Eligibility: You must be at least 18 years old to use the Platform.

Accuracy: Users agree to provide accurate, current, and complete information during registration.

Driver Requirements: Drivers must possess a valid Australian driver's license, a registered vehicle, and comprehensive compulsory third-party (CTP) insurance as required by Queensland law.

3. Financial Terms and Commission

Payments: Passengers pay the total trip fee upfront via the secure Stripe Checkout interface integrated into the Platform.

Payouts: DinkiRide collects the total payment, retains a platform service fee (commission), and automatically routes the remaining balance to the verified Driver's bank account via Stripe Connect Express.

Fines: DinkiRide is responsible for identifying, managing, and paying any administrative or regulatory fines levied against the Platform's core operations by Australian authorities. However, traffic violations, speeding tickets, parking fines, or vehicle safety fines incurred during a trip are the sole legal responsibility of the respective Driver.

4. Refund Policy

DinkiRide operates a ridesharing platform built on mutual trust and respect for the time of all community members. In order to safeguard passengers' flexibility and right of withdrawal, while simultaneously protecting drivers' scheduled time, opportunity costs, and fuel expenses, a regulated cancellations and penalties framework is hereby established. Acceptance of these conditions is mandatory for all registered users operating within the territory of Queensland.

4.2. Free Cancellation Window

Passengers may cancel a previously confirmed booking through the system free of charge, provided that such cancellation request is made strictly within the first five minutes immediately following the exact moment the assigned driver accepted the ride request on the platform.

*Applicable Operational Exception: Notwithstanding the aforementioned five minute grace period, if the assigned driver completes the approach route and physically arrives at the designated pickup location before the total expiration of this courtesy window, the right to free cancellation shall be automatically revoked, and the fee established in Section 4.3 shall apply immediately.

4.3. Late Cancellation Fee

A flat and invariable late cancellation fee of $5.00 AUD (five Australian dollars, inclusive of GST where legally applicable) will be automatically generated and charged via the secure payment gateway to the credit card, debit card, or electronic payment instrument linked to the passenger's account under the following circumstances:

a) When the passenger voluntarily cancels the booking more than five minutes after the driver has accepted the ride request.

b) When the driver has completed their arrival at the designated pickup location within the estimated time, and the passenger fails to appear at the vehicle or desists from the trip after a courtesy waiting period of five minutes, counted from the driver's notified arrival.

5. Prohibition of Platform Circumvention and Disintermediation

5.1. Restriction on Exchanging Contact Information

The utilization of internal communication channels, in-app messaging, or private chats integrated within the DinkiRide application for transmitting, revealing, or exchanging personal data and direct contact details is strictly prohibited. This includes—but is not limited to—personal phone numbers, email addresses, links or names of external social media profiles (such as WhatsApp, Instagram, Facebook, or TikTok), or any other direct communication method outside the software infrastructure provided by the company.

5.2. Enforcement, Penalties, and Exclusion of Liability

Any deliberate or effective attempt to bypass the platform's centralized booking and payment system (a practice known as disintermediation) to arrange cash payments or transactions outside the controlled Stripe environment shall constitute a material breach of these terms of use. In the event of such conduct, DinkiRide reserves the right to provisionally suspend or permanently terminate access to the account of the infringing user (whether passenger or driver).

6. Limitation of Liability

To the maximum extent permitted by law in Queensland, DinkiRide shall not be liable for any indirect, incidental, special, or consequential damages arising out of or in connection with the rides arranged via the Platform, including but not limited to personal injury, property damage, delays, or missed connections.
